barricading himself inside a house on high street in oakland. now initially the suspect had held a man, woman, and a child hostage, but all three were released safely just before midnight. oakland police tell us the suspect spent most of the night inside the home pacing with a gun and a cell phone. police say the suspect is one of three men who fired on sheriff deputies then led them on a car chase near 41st avenue and international boulevard last night. two of those suspects are now in jail, another is still on the loose. on now to decision 2012. yes, it is election day and the polls will be opening about one hour from right now. this year, the ballot a little different this time around. california voters testing a brand new system in selecting those candidates. marla tellez is live in san jose with more on this major change out there. marla, good morning. >> reporter: jon, good morning. it is all about the top two. the two candidates who snag the most votes. they will face off in november.

so forget about majority rules. now, this new system, go figure, it is called the top two system. now come november, this could give momentum to a new candidate who is not a favorite, for instance, but who got enough votes to land in the top two. now, also new this time around, independents can vote in this june primary for the first time in state history. political experts say their votes could make all the difference in an election that's predicted to have low voter turnout. now, take, for instance, the state's prop 29, a yes vote means a $1 tax on a pack of cigarettes. >> i tend to think a lot of the independents in the state would've voted for it and they're not acclimated to voting in these cycles. so it's going to be really close. >> mentioned the low voter turnout. experts are predicting about 40% turnout. republicans are more apt to vote than liberals. once again, independent voters

could make a big difference in today's primary. the polls open in less than an hour at 7:00 and they'll stay open until 8:00 tonight. it is not an official polling place, of course, but you can bring your ballot here and they have a 24-hour drop box again until 8:00 tonight. live in san jose, marla tellez, "today in the bay." also in san jose, voters could have an impact on pension plans statewide. measure "b" is backed by chuck reed and taxpayer groups. it limits retirement benefits for future city hires and would actually force new workers to pay half the cost of their pension. current employees would have to choose a more affordable plan for the rest of their years on the job or contribute to an additional 16% of their salary actually to continue with existing benefits. unions representing city workers say the measure is illegal and unfair. both sides of the issue have spent more than $1 million on advertising. supporters have raised $740,000, opponents have pulled in

$525,000 in money and services. and if you haven't turned in your absentee ballot just yet, you can do it in santa clara without even stepping out of your car. there's several new drive-thru ballot dropoff locations open from 7:00 this morning until 8:00 tonight. and we'll give you a quick rundown of all those locations. the milpitas dropoff at mccarthy ranch. morgan hill at the vta park. palo alto at the mayfield soccer complex. san jose, eastridge. make sure to stay with nbc bay area for all the coverage of tomorrow's primary. you can also read more about the candidates and all the issues on our website. of course, that's nbcbayarea.com. an east bay crime could be a knockout punch for a program aimed at keeping kids off the streets. thieves have broken into an oakland boxing club, cleaned it out.

christie smith live with the latest blow to the struggling facility. good morning. >> good morning to you, laura. a few months ago we were out here because this nonprofit was in danger of closing. now this, over the weekend, somebody hopped the fence here and broke in. they stole laptops that kids use, tv, dvd player, basically all the electronics here at the east oakland boxing association that teaches kids boxing. they also teach things like job skills, gardening, and they have an art program. it's provided free after school programs and summer programs for 25 years. now, a few months ago, they bounce back from a financial shortfall through donations and fund raising. but coming up on june 25th, a hundred kids have signed up to start the program and here they are struggling again. >> when you walk in here and you just have the respect and the kids are supportive of each other, the older kids that are working with the younger kids, i mean, it's just a very unique place. and it's really a shame that

somebody had to come in and disrupt that. >> the thieves also took a nintendo wii, boxing equipment, and even the telephone. so this group is asking for the public's help. they're holding a music blues fundraiser, that's planned for june 10th at yoshi's jazz club here in oakland. christie smith, "today in the bay." new developments this morning in the search for a morgan hill teen sierra lamar. calling off the water search in the reservoir, but dive teams, well, they searched the reservoir extensively after the mother of the suspect antolin garcia-torres told investigators her son was fishing there the same day sierra disappeared. garcia-torres accused of kidnapping and murdering sierra lamar. he's right now being held without bail. he is due back in court next month. 6:06. we're going to find out today if suspended san francisco sheriff ross mirkarimi will have to turn over critical evidence.

trying to keep private phone calls and text messages to friends and colleagues in the days after bruising his wife's arm and being held on charges of domestic abuse. the mayor wants the records to make his case to remove mirkarimi permanently. the final ruling will come at a hearing this morning. okay. the calendar says june, but we tell you what looks more like january up in the sierra. how about this? snow lining the highway and streets out there. that's right. so some visitors have a chance to get out and get in it. there's several inches on that ground right now and we're being told there will be -- i guess the question is, will there be more snow falling today? >> well, we will check in with our expert, meteorologist christina loren here to tell us. >> well, thank you. i've never been referred to as an expert before. good morning to you. but i'll take it from laura garcia-cannon. we do have showers coming down, and some of the showers still coming down, we have very live

activity, but we do have snow coming down over the sierra nevada. looks like what they picked up yesterday and what they are getting this morning might actually stick around, at least in the shade for today. but we've got a big-time warm-up on the way and so keep that in mind if you are going to be headed up to the sierra nevada. it's not going to last, but it will be very comfortable to hit lake tahoe as we head into this weekend. 51 degrees in san mateo and 51 degrees to start you out in livermore. it is nice and clear out there. and we don't really have any fog to report. ragged patches hugging the coastal mountains, but overall, we've got winds that are strong enough to keep that fog from getting very dense settling right to the surface. so it all works out like this today, 68 degrees at noon, that makes way to 72-degree weather inland as we round out the day. and because the sun is going down later, our highs come in between 4:00 and 4:30 this time of year. we'll have your seven-day forecast coming up. now mike has the day off. i'm doing double duty and we've got a couple things to point

out, we told you earlier about a disabled big rig 680 southbound after i-80 taking up the right lane and it has been for the past 15 minutes. you can imagine, delays are stacking up, doesn't look like it'll be cleared for another 30 minutes. otherwise, a new crash to tell you about. this one is in the city of san francisco. and reportedly involving a motorcycle. 101 northbound just past marina boulevard. it's taking up the center lane. moderate delays already. give yourself extra time for that, as well. those are the only two incidents that we have to report. back to you. >> thanks so much, christina. well, they say one man's trash, another man's treasure. the city of san jose has a new policy that enforces it. the city says it will no longer throw away items confiscated during sweeps of homeless camps. now, people's possessions will be tagged and stored for 90 days. the city is shifting money to fund that inventory program.

a major milestone to tell you about today, a san francisco general hospital, the final steel beam will be placed in the new hospital at about 10:30 this morning. it's a topping off ceremony going on there. being built using an earthquake-resistant design. the hospital says during an earthquake, base isolator technology lets this building slide and bob 30 inches in either direction or any direction for that matter. the hospital is expected to be completed in 2015. 6:10, there's going to be a party going on, or at least continuing in london this morning. we've got a live look at a diamond jubilee celebration. they are celebrating queen elizabeth's 60 years on the throne. the royal family leaving the westminster palace right now heading to buckingham palace. one member is absent, however. 91-year-old prince philip is in the hospital being treated for a bladder infection. not able to participate in all

welcome back, taking a live look outside. golden gate bridge, looks like traffic's moving pretty smoothly. moving pretty smoothly. >> now you're smooth. all right, it is 6:14. it's early for some folks, late for others. >> well, you know what? it's all relative right now at 6:14. and it's relatively good news for some drivers out there. the price of gas is down this morning, it's been slipping a little bit for the last few weeks. "today in the bay's" bob redell is live in san jose with how much people are right now paying for that gas. bob, good morning. >> good morning to you, jon. well, nationwide the price for an average gallon of gas has fallen so much that the country's almost where it was eight months ago. as you can see here on the west coast, the drop has not been as dramatic. but at least one analyst predicts we could soon see a dramatic decline. prices here in the bay area are

down from a week ago. take a look at the overnight numbers from aaa. san jose, oakland, averaging around $4.22 for a gallon of gas, san francisco, no surprise, bit higher at 4:30. if you would look at those prices today and compare it to seven days ago, down six, seven cents a gallon. >> the time i remember when prices were low and i remember when they got quite high, and i remember when we were waiting in line to try to get gas. so it's good to be able to get gas. but, boy, it does affect your budget today. it sure would be nice if we could get a break. >> reporter: not clear how much more of a break we're going to get. depends in part on the price of oil. one analyst tells the l.a. times that's why we've seen the drop in the price of gas. remember when it seemed like we'd always be at $100 a barrel or higher. well, barrel has sunk to low to mid-80s. oil's down because of the pressure on the u.s. and chinese

economies. there are signs that growth in both countries could be slowing. bob redell, "today in the bay." it is a race second only to the presidential campaign in national interest. wisconsin voters actually go to the polls today to decide whether to recall governor scott walker. walker, of course, made national news when he stripped governor workers of their collective bargaining rights. polls show the race is tight between republican walker and tom barrett. california was the last state to replace the governor through a recall election. new this morning, jury selection underway for the trial of former penn state assistant football coach jerry sandusky. sandusky is accused of sexually abusing ten boys over several years. he has denied these charges. now, some of the alleged victims expected to testify during his trial. lawyers, well, they're concerned about whether an impartial jury can actually assemble in this close-knit community. some of the jurors may be summoned from other areas, and

testimony is expected to get underway on monday. now reporters there covering this thing are going to have to cover sandusky's trial the old-fashioned way. the judge overseeing this case deciding there will not be any electronic communication allowed in this courtroom. that means no tweets and no live updates or blogs. and you won't be seeing any video actually of this trial either. pennsylvania law bans cameras from inside courtrooms. the giants head south to san diego today to take on the padres. they're coming off their first sweep of the season against the cubs. it was a pretty good one. fifth inning, bases loaded, buster posey scored to tie the game at two, bases loaded in the seventh. joaquin arias with a hit. yeah -- >> hang in there. >> did i tell you they swept it? they swept it, yeah. they finished it too. 3-2. they got the brooms out. let's take them again down south. meantime, sanford pitcher didn't

get the number one pick after all. but the junior was ranked as the top player in the draft. but he slipped to pittsburgh pirates for the eighth pick. the word is several teams were worried how much it was going to take to sign him to a contract. he's being advised by baseball super agent scott boris. >> yeah, boris will still make sure he gets paid. >> oh, yeah. >> the number one pick is an honor, you get more dough out of it. but right now it's free of charge for the weather forecast, which is priceless, meteorologist christina loren. >> you also have to live up to it. and i'm going to live up to that nice forecast i promised you yesterday. it's going to be nice. no showers at this point. live outside showing you the camera has a shake to it, and we still have high and mid-level clouds out there, but the low clouds absent over the bay this morning. that's the good news, you don't have to contend with the fog. and we do have slick conditions. areas of ponding and puddles that have not dried out yet.

let's talk about what's happening out there today. the winds will continue to play a factor out of the west at 14 miles per hour, rather strong in ferairfield this morning. mild winds along the peninsula. they're going to gust throughout the day as high pressure moves in and low pressure moves out. the two systems create a tight pressure gradient. temps on the cool side. 44 degrees in gilroy, getting rather cool down there, dress for the two parts of the day. layer up today because by noon, temperatures in the upper 60s inland. and a nice day at the coast, as well. warm weather back into the mix right at the coast and bay side as we head through your wednesday. and we're going to keep that warm weather handy all the way throughout this weekend when temperatures will start to climb. sunday looks fantastic for outdoor plans. if you wanted to get anywhere towards the coast and soak in that sunshine it's going to be a beautiful day sunday. 72 degrees, 71 for san jose, and 68 degrees in livermore.

temperatures up by about 10 degrees from yesterday's highs. it was a cool day yesterday, tomorrow 80 degrees, the 80s return for thursday, and friday into saturday, we keep warming you up. really good-looking finish to the weekend. and then by monday, holding on to warm weather, summer-like weather as we get closer and closer to that date. it is a traffic tuesday, but rather uneventful so far. we've got a couple things to point out. disabled big rig at 680 southbound after i-80. we know there's a crew out there working on getting that cleared, be uh it's an 18 wheeler. it will be a lengthy process. you can see a little bit of yellow on your map. give yourselves extra time through there. an earlier crash in the city, this one's involving a motorcycle. 101 northbound just past marina boulevard and that's reportedly blocking the center lane. so you want to keep that in mind, give yourself extra time for this, as well. there's a crew on the scene and they're getting ready to push that over to the right-hand shoulder. we'll update you on weather and traffic all morning. back to you guys. >> double-duty loren, nicely done.

thank you very much. kind of like the classic horror movie "poltergeist," they're back. the guys from napster. scott, i guess we'll know soon what air time -- >> air time, yeah. the napster guys will launch air time at a press event in new york city even though it's a san francisco-based company. you remember chat roulette that video conferencing software? the best guess is that this air time thing is a facebook oriented sort of chat roulette. is the world changing? probably not, but it's not every day the napster guys launch a new company. meanwhile, facebook has its failure made it harder for young start-ups to succeed? the founder of a dozen of start-ups wrote a letter to young entrepreneurs warning they may not get the funding they're looking for from venture capitalists because they've been spooked by facebook's failure in the stock market. shares in facebook fell again monday to the lowest point ever

under $27 a share. that's a new low. wall street continues to watch europe, spain has explicitly said it's having trouble borrowing money and has asked the european union to recapitalize its banks. europe is a trap door. it hasn't opened yet, it may never open, but 20% of the world's economy is jumping up and down on it. and some airlines are thinking about charging $25 for carry ones to discourage people from bringing those ridiculously big suitcases into the airplane cabin. people tend to do this to avoid paying the $25 to check the bag underneath the airplane, but all you're doing is moving the problem to the cabin. i'll take a backpack -- >> don't they have limits of the size of the bag you can bring? >> yes, and so if you bring a small one like a purse or backpack, no charge. if it doesn't fit in the thing, they're going to charge you $25 is the proposal. which i actually support. i think it's a good -- >> okay. i thought it was for $25, you know, for any -- that pen right

decision 2012 right now. president obama hoping to keep those dollars flowing back in the bay area less than two weeks after his last visit. air force one scheduled to touch down at sfo at about 11:40 this afternoon. he'll depart for l.a. four hours later. mr. obama scheduled to attend a luncheon at the julia morgan ballroom in the financial district. lunch and a picture with the president costing you $7,500. the president teamed up with former president bill clinton at a new york fundraiser monday. "today in the bay's" tracie potts live in washington says that was the first time they'd been together since mr. clinton defended mitt romney's business record. interesting. >> reporter: it is interesting,

laura. remember president clinton called mitt romney's business record sterling. a number of democrats came out against president obama and the ad. his campaign was running against his business record and so now you see the president switch more focusing on mitt romney's record as governor of massachusetts. together yesterday in new york president obama and former president clinton raised $3.6 million at three fundraisers around the city. in fact, one of them was $40,000 a plate. a reception there. the former president said he wanted to ensure the reelection of president obama saying that he promoted 21st century policy and basically did the best that he could with a lousy hand. laura? >> all right. we'll see where we go from here. thank you very much. 6:27 right now. still to come on "today in the bay," a key decision regarding the prop 8 repeal.

face a very different ballot for the first time. "today in the bay's" marla tellez with more on the historic primary election. >> reporter: good morning. when you head to the polls today, think top two, this is because of the new system that prevails today. it is called the top two system. now what it means is the two candidates who snag the most votes will face off in november even if one gains an outright majority today. so majority no longer rules here. the new system also means your ballot includes all candidates of all parties for state legislative house and u.s. senate offices. so you can expect a longer list of candidates. now, to be clear, the top two process does not apply to the presidential nomination. statewide political experts expect a low voter turnout of about 40%. now, i just spoke to the santa clara county registrar voters, and he said of the more than 745,000 ballots mailed out, only 19% have been returned so far.

>> it's typical. during the primary election, there's always between 40% to 50% turnout, give or take, what's on the ballot and where we are in the presidential primary. but it's pretty much all wrapped up, i don't think it's going to bring increased turnout, but we're looking at average 40% to 50%. >> reporter: now, turnout percentages statewide could hinge on independent voters because for the first time they can vote in today's primary. the polls open in less than 30 minutes at 7:00, staying open until 8:00 tonight. you're advised to head to your local polling place. if you can't make it there, you can vote at the registrar of voters. live in san jose, "today in the bay." the state's new primary system, that means lines will be longer. voters will decide which of 23

challengers will take on dianne feinstein in november. a non-profit executive from danville, a surfing rabbi, and an 80-something former marine. now you can vote for any of them regardless of how you are registered. the top two candidates with the most votes advance to november regardless of party. keeping kids safe is the goal of a proposed law in san jose. city leaders will take a final vote on the tough new social host ordinance inspired by the tragic death of the south bay teen in a drunk driving accident two years ago. leland high grad was a passenger in a car that crashed on the expressway. police say the driver had been drinking. now, under the new law if there is an underage drinking party in a home, the homeowner is liable for anything that happens. an east bay program designed to keep kids off the streets has suffered a serious blow. thieves breaking into the popular boxing club. they just cleaned out thousands

of dollars in valuables. christie smith live in oakland right now where the community is scrambling trying to keep the doors open at this club. christie, good morning. rough out there. >> it is. good morning to you, jon. this place is well known in the neighborhood as a place that helps kids who need it most which makes it even worse that someone broke in here over the weekend and took laptops that kids use, video games, even the phones off the desk from the east oakland boxing association which has been offering free and after school summer programs for 25 years. the place was robbed over the weekend when they came in monday afternoon. even boxing gear and water bottles that were used for fund raising were gone. now they have to figure out a way to help the kids who have signed up for a summer program that starts on june 25th. these kids have really been looking forward to it. >> when you walk in here and you just have the respect and the kids that are supportive of each

other, the older kids working with the younger kids. it's just a very unique place. and it's really a shame that somebody had to come in and disrupt that. >> now, just a few months ago, we were out here doing a story because the program was in jeopardy, could possibly close because the funding had dried up. but they were able to bounce back from that. now they're asking for the public's help again on june 12th. they're holding a blues benefit concert that is at the jazz club in oakland that starts at 8:00 at night. christie smith, "today in the bay." 6:36, another key legal step today for proposition 8. the federal appeals court will announce its decision this morning on whether it will review a three-judge panel's ruling that overturn the state's ban on same-sex marriage. now if justices agree to the ruling, a larger panel of 11 judges will then hear the case. it could take another year, and the move to issue a step closer

porn actor suspected of murdering and dismembering a chinese exchange student expected in a court appearance. the 29-year-old is wanted by canadian authorities on suspicion of killing a man he dated and then mailing his body parts to two of canada's top political parties before running off to europe. now canada is requesting magnata's extradition from germany. peru's top court says joran van der sloot will not be extradited to the u.s. any time soon. reports this morning peru's supreme court made that ruling last week. the court ruled van der sloot th has to serve 28 years in prison before he can be extradited. the 24-year-old is wanted in connection with to the 2005 disappearance of alabama teenager natalee holloway. and new this morning, jury selection underway for the trial of former penn state assistant football coach jerry sandusky. sandusky, of course, accused of

sexually abusing ten boys over several years. some of those alleged victims are expected to testify during his trial. lawyers right now, they're concerned about whether or not an impartial jury can be seated in this very small and tight community. some of the jurors may be summoned from other areas. testimony expected to get underway monday. it is a race second only to the presidential campaign in national interest. wisconsin voters go to the polls today to decide whether to recall governor scott walker. walker made national news last year when he stripped government workers of their collective bargaining rights. that decision led to that huge recall effort. polls show the race is tied between republican walker and democratic milwaukee mayor tom barrett. california, you'll recall is the last state to replace the governor through a recall election. well, looks like new york could be the next state to legalize marijuana. governor andrew cuomo wants to make possession of small amounts of pot legal even if it's out in

sold in bay area stores before rolling out nationally. the goal is to popularize the french bakery experience right here in the u.s. well, maybe this is why president obama's coming back to the bay area. he's coming back again. this time for a quick lunch, though. air force one scheduled to touch down wednesday at 11:40 a.m., depart for l.a. four hours later. mr. obama scheduled to attend a luncheon at the julia morgan ballroom in the financial district. lunch and a picture with the president, $7,500. president obama you'll recall recently raised several million dollars for his reelection campaign during a visit to the south bay less than two weeks ago. >> that limo can get away with speeding. san jose will no longer be throwing away homeless people's belongings. they'll be tagged and stored away for the homeless for 90 days. san jose's independent police auditor recently reminded leaders about a long forgotten city policy that requires the

city to catalog and store a homeless person's belongings. city leaders now shifting money around to try and fund the inventory program. we will find out today if suspended san francisco sheriff ross mirkarimi will have to turn over critical evidence. mirkarimi is trying to keep private phone calls and text messages to friends and colleagues in the days after bruising his wife's arm private. the mayor wants the records to make his case to remove mirkarimi from office permanently for official misconduct. a judge has issued a preliminary ruling to release the records. a final ruling will come at the hearing this morning. there are new efforts in the search for sierra lamar. sheriff investigators calling off the water search. dive teams were searching the reservoir extensively after the mother of suspected -- the suspect there antolin garcia-torres told investigators her son was actually fishing there the very same day that sierra disappeared. investigators say this is not the end in that search for

sierra. >> it was a less scheduled kind of planned search. it doesn't mean that the searches are going to stop, just from here on now, they're going to be more target focused. >> they know what they're doing. they know what they found and not found and so i have confidence in what they're doing. >> garcia-torres accused of kidnapping and murdering sierra lamar back in court next month. 6:55. the man suspected of shooting at a sheriff's deputy is now in custody after a seven-hour standoff. the suspect surrendering at 3:00 a.m. after barricading himself inside a house in oakland. initially, the suspect had held a man, a woman, and a child hostage but all three were released safely. oakland police tell us the suspect spent most of the night inside that home pacing with a gun and a cell phone. police say the suspect is one of three men in a stolen car who fired on sheriff deputies then led them on a chase near 41st avenue last night.

two of those suspects are also now in jail. another still on the loose. >> and police in the east bay right now investigating a burglary that could close the door to a summer program that helps keep kids off the streets. christie smith live in oakland right now where thieves stole a number of items from very popular boxing club. good morning. >> reporter: good morning to you, jon. yeah, this place is well known in the neighborhood for helping kids that need it the most. well now over the weekend, someone broke in and helped themselves to the equipment that supports the east oakland boxing association. thieves stole laptops that the kids use, even water bottles meant for a fundraiser to be sold. tv, dvd player, boxing equipment. the program has provided free summer and after school programs for 25 years here in east oakland. but the next summer session starting in about three weeks they provide also job skills, nutritional information, there is a garden here for the children that come here. well, now they are looking for donations from the community. they're also holding a music

fundraiser on june 12th at yoshi's jazz club here in oakland. christie smith, "today in the bay." >> 6:56 right now. for more on decision 2012. in just a few minutes, polls will open for this year's state primary election. marla tellez live in san jose with why this election is like no other. good morning, marla. >> reporter: good morning. it's all because we are using a whole new system. it's called the top two system to be clear. this does not apply to presidential nominations. now, specifically it means that the two candidates who land the most votes will face off in november even if one earns an outright majority today. the november runoff may also pit two candidates from the same political party against each other. another factor this year is redistricting. new legislative districts have been drawn and this could dramatically affect incumbents. one of the biggest factors, though for the first time in california, independent voters can vote in today's primary. in a primary when low voter

turnout is expected, the independent vote could be crucial. now, voter turnout statewide and locally is expected to be about 40%, which is typical for a primary. the polls open in just a couple minutes and they stay hope until 8:00 tonight. live in san jose, marla tellez, today in the bay. if you're planning on filling up your gas tank this morning, it's like an early christmas sort of. bob redell live in san jose with a look at the prices that are starting to go down at the pump. good morning. >> good morning to you, jon. not as much as the rest of the country. if you go east of the rockies, prices have gone near eight-month lows. especially the past seven days here in the bay area, prices going down about a penny a day. take a look at the latest numbers from aaa, an average gallon of gas here around $4.22 a gallon. san francisco a little bit higher as is always the case around $4.30 a gallon. if you compare that to seven days ago, down six to seven cents. this is due to the price of oil.
